Circular No. 20/2022: Key Legal Issues on Rights, Duties & Powers of Strata Homeowners & Management Bodies (10 June 2022)

Please be informed that the Continuing Professional Development and the Publications & Information Technology Sub-Committees of the Johore Bar Committee are organising the above titled Webinar.

Residential strata schemes present difficulties in relation to rights of strata homeowners and powers of management bodies that have not been sufficiently appreciated by our legislature.  Although the Strata Management Act 2013 came into force in 2015, a number of important questions about its intersection with other areas of law concerning the rights of proprietors and the extent to which management bodies can assert its powers in regards to the maintenance and management of common areas remain unanswered. It is prudent to assess the case laws of other jurisdictions such as Singapore and Australia given that our case precedent is still developing since the 2013 Act came into force approximately 7 years ago. The talk will focus on the following key areas:

  • What do you actually own exclusively in a strata scheme and what do you own collectively?
  • What are the rights of strata homeowners to renovate or make alterations to their respective parcels?
  • What happens when there are violations of the Strata Management Act 2013 and the regulations therein?
  • Are the statutory enforcement mechanisms adequate and effective?
  • What role does the property manager play in a strata scheme and is the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 (Act 242) adequate in safeguarding the rights of strata homeowners?
  • What are the duties of management committee members and what protections, if any, are accorded to the management committee by law?
  • How we prevent fraud and embezzlement in strata management and what can homeowners do in law to safeguard the management corporation’s funds?
  • How to effectively resolve disputes in strata schemes?

About the Speaker

SARASWATHY SHIRKE DEO started her career as principal lecturer in law in 1999. She has lectured law students in several local law colleges and university colleges. Her subjects of expertise are Constitutional & Administrative law, Tort, Contract law, Medical law, Employment law, Company law, Cyber law and Media law. She has lectured these subjects in both the UK and Australian law programmes. After leaving academia, she pursued practice of law in 2013 under leading litigators, putting her knowledge in substantive law to handle civil litigation. She currently practices under her own boutique law firm Messrs Sara Deo & Co, focusing exclusively on the line of substantive areas of law that she has lectured. She has published several articles in law journals for over a decade. She also gives lectures and talks on subjects of her interest with her characteristic engaging style, delivering complicated concepts in a crisp and simple manner.
