Circular No. 37/20: Updates on Conveyancing Matters

By letter dated 17/06/2020 to Pejabat Tanah dan Galian Johor [“PTG Johor”], the Conveyancing Practice Sub-Committee [“CPSC”] had proposed certain measures to resolve issues faced by members at PTG/D. PTG Johor’s response dated 22/06/2020, received on 23/06/2020 is as follows.

Increasing the Queue Numbers for Presentations

a. State Bar’s proposal

To increase the queue number from 50 to 100 or more subject to observance of the SOP implemented.

b. PTG Johor’s response

The number is to be retained at 50 in order to comply with the SOP in place to control the number of visitors to PTG Johor.

2. Searches

a. State Bar’s proposal

In order to reduce the waiting time and to avoid congestion at PTG/D, it was suggested that all search applications together with cheque payments be placed in a self-addressed envelope, which then will be presented to the staff on duty at at a counter/table designated to receive said applications.

PTG/D then to return the search results together with the accompanying receipt to the legal firm concerned using the aforementioned self-addressed envelope.

b. PTG Johor’s response

Search applications for more than 5 titles not connected with a legal firm’s presentation for that day, can be done at the search counters via “drop off” with effect from 18/06/2020. Search results will be issued within 7 working days, depending on the volume of the search applications.

3. Application for Consent to Transfer “Tanah Kurnia” and Foreign Citizens’ Share in Land [“Consent Applications”]

a. State Bar’s proposal

Per proposal at Item 2 above. Upon approval of Consent Applications, PTG/D to email legal firm concerned for collection.

b. PTG Johor’s response

Consent Applications had been submitted via “drop off” with effect from 04/05/2020. This mode, however, had to be dicontinued as there were issues concerning incomplete documentation and payments by cash. Receipts for payments, whether by cash or cheque, will be issued once the documents are verified as complete.

4. Increasing the number of PTG/D staff post 09/06/2020

a. State Bar’s proposal

Our proposal was premised on the fact that Johore is no longer listed as a red zone. The objective of the proposal was to expedite the clearance of pending transactions within the contractual completion periods to avoid litigation between the contracting parties.

b. PTG Johor’s response

PTG Johor has been operational at full capacity since 31/05/2020.

5. Opening for business on Fridays and Saturdays

a. State Bar’s proposal

The objective of the proposal was also to expedite the clearance of pending transactions.

b. PTG Johor’s response

PTG Johor had opened for business on Friday (05/06/2020) and Saturday (06/06/2020). Thereafter, as an alternative, the business hours for the presentation counters were extended to 5.30 pm commencing 17/06/2020. This exercise was stopped on 23/06/2020 since, by PTG Johor’s observations during the implementation period, the number of transacting parties present after 4.30 pm did not justify keeping these counters open after this time.

In addition to the above, “Pindaan Syarat Nyata Bagi Perumahan Rakyat Johor” dated 31/05/2020 issued by PTG Johor, which is self-explanatory, is attached.
