The New Guidelines on Acquisition of Properties by Foreigners in State of Johor were issued by PTG Johor on 11th February 2014 vide ‘Pekeliling Pengarah Tanah Dan Galian Johor Bil 2 Tahun 2014’. The New Guidelines will come into force on 1st May 2014.

A copy of the New Guidelines is attached hereto for your attention.

The Conveyancing Sub-committee together with REHDA and Association of Valuers were invited by the PTG Johor for a dialogue session on 19-2-2014 with respect to the implementation and enforcement of the New Guidelines. The Conveyancing Sub-committee raised, inter alia the following issues which require the PTG’s further action:

(a) Pursuant to Section 433B of the NLC, NO approval is required for industrial properties. Therefore, the New Guidelines with reference to industrial properties do not apply. PTG Johor has agreed to review the issue and revert; and

(b) In applications for approval for acquisition of properties by foreigners from Malaysian citizens or Malaysian companies in the sub-sale market, approval shall be on a case by case basis (paragraph 5.5.3). PTG Johor will issue further new guidelines with respect thereto.

Minutes on other issues raised during the dialogue session will be circulated to members upon finalization thereof.
