Circular No. 67/20: Notification of Court Operations During the Conditional Movement Control Order Period in Johore

On 7th November, 2020, the Senior Minister and Defence Minister, YB Dato’ Sri Ismail Sabri Yaakob announced the enforcement of the Conditional Movement Control Order [“CMCO”] in several states, including Johore. The CMCO period will be from the 9th November 2020 to 6th December 2020 [“CMCO Period”].

Following this announcement, the Chief Registrar of the Federal Court of Malaysia, Tuan Ahmad Terrirudin bin Mohd Salleh issued a media statement entitled “Pemakluman Pengendalian Kes-Kes Di Mahkamah Negeri Terengganu, Negeri Sembilan, Johor, Perak, Kedah, Pulau Pinang Dan Melaka Selaras Dengan Perintah Kawalan Pergerakan Bersyarat (PKPB) Dan Di Mahkamah-Mahkamah Negeri Selangor, Wilayah Persekutuan Kuala Lumpur Dan Wilayah Persekutuan Putrajaya Selaras Dengan Sambungan PKPB Dari 9 November Hingga 6 Disember 2020”. The Bar Council Circular No. 391/2020 dated 08/11/2020 refers. [“BC Circular”] [APPENDIX-1].

Information pertaining to the operation of the courts in Johore during this CMCO Period is referred to below, with the corresponding circulars/announcements attached, which are self-explanatory.

  1. BATU PAHAT

(a) JADUAL BERTUGAS MAHKAMAH SESYEN DAN MAJISTRET BATU PAHAT SEPANJANG PERINTAH KAWALAN PERGERAKAN BERSYARAT (PKPB) [APPENDIX -2]

The Magistrates and court staff will be on rotation duty. However, since Tuan Mazelan Bin Jamaludin is the sole Sessions Court Judge in Batu Pahat, he will sit daily during the CMCO period.

(b) PENETAPAN TARIKH BARU BAGI KES-KES SIVIL & JENAYAH MAHKAMAH SESYEN BATU PAHAT [APPENDIX-3]

2. JOHOR BAHRU

(a) HIGH COURT

Deputy Registrar, Puan Azureen Sahira Binti Sauffee Afandi, confirmed that all matters involving the physical attendance of the lawyers and the public are adjourned to a date to be notified. Cases scheduled online (ie e-Review, email, Skype, Zoom etc) will proceed as scheduled. The High Court Officers’ duty roster is attached as APPENDIX-5 

(b) SUBORDINATE COURTS [CIVIL & CRIMINAL]

Director of Courts, Johor, Tuan Mohammad Haldar Bin Abdul Aziz confirmed that no trials/ hearings (fresh or part heard) will proceed. Matters disposable via zoom, email & e-review will continue as scheduled. Consent judgments may be recorded via the e-Review system before the presiding Magistrate or Sessions Court Judge.

Remand matters and fresh charges will proceed.

3. KLUANG

All matters falling within the CMCO Period are adjourned. The rescheduled dates will be made available to members once its received from the court.

4. MUAR

(c) HIGH COURT

Deputy Registrar of the Muar High Court, Puan Noor Shahidah Binti Saharom confirmed the following directions concerning conduct of matters in the High Court:-

(i) High Court 1

Save for interlocutory applications, all trials are rescheduled. The list of matters before High Court 1 during the CMCO Period and those rescheduled to a date thereafter is attached here as APPENDIX-7. Please also liaise with the High Court 1 Interpreter should you require further information.

(ii) High Court 2

Except for trials, other matters will proceed as usual via zoom. The list of matters proceeding and rescheduled will be made available to members once its received from the Senior Assistant Registrar, Puan Kartini Binti Kasran.

(iii) Matters before the Deputy and the Senior Assistant Registrars

These matters will proceed per usual by Case Management via email or e-Review. Matters requiring attendance in court will be rescheduled and the dates will be notified in due course.
