The Professional Development & Education Sub-Committee is organizing a Seminar entitled “Navigating Estate Administration and Property Distribution in Malaysia”.
The administration of a deceased’s estate and the subsequent transmission of property remain highly technical areas of practice in Malaysia. Failing to navigate these procedures accurately can lead to prolonged probate delays, family disputes, and significant financial losses. This seminar is designed to provide a comprehensive, step-by-step breakdown of the legal and procedural pipelines governing estate management from initiation to final distribution.
WHAT WILL BE COVERED:
Part 1: Estate Administration – Basic Law and Applications
• Applying for a Grant of Probate: A comprehensive, step-by-step guide on how to initiate and secure a Grant of Probate application when the deceased left a valid Will;
• Applying for a Letter of Administration (LA): Navigating the legal complexities and procedural requirements to successfully petition for an LA when a person dies intestate (without a Will);
• Applying for a Distribution Order: Mastering the transition from administration to actual asset division, ensuring the estate reaches its beneficiaries legally and smoothly;
• Samples of Cause Papers: Gain access to practical samples of essential court documents and cause papers used during the filing process;
• Interactive Q&A on Basic Estate Administration Issues: An open floor to clear up complex, everyday hurdles, including asset tracing, debt clearance, and dealing with financial institutions; and
• Dedicated Q&A on Small Estate Distribution Applications: Answers to queries regarding the Small Estates (Distribution) Act 1955, including land office jurisdictions and dispute resolutions.
Part 2: Estate Disposition to Beneficiaries
• Preparing Transmission and Transfer Documentation: Learn the precise drafting and compiling requirements for registering a Transmission (to the Executor/Administrator) and subsequent Transfer documents (to the ultimate beneficiaries) for immovable property;
• Completing the Transaction Successfully: A clear roadmap on navigating the Land Registry/Office, managing adjudication, handling stamp duty exemptions or remissions, and ensuring the final registration of titles;
• Samples of Transfer Documents: Review and retain operational samples of key transactional instruments, including Form 14A (Memorandum of Transfer), supporting affidavits, and statutory declarations; and
• Dedicated Q&A on Transmission and Transfer Procedures: Clarify practical bottlenecks at the land office, dealing with missing master titles, or handling properties still restricted by developer consent or bank charges.

About the Speakers
Joshua Kuan Kai Wen was called to the Malaysian Bar in 2012. He has attained Bachelor’s Degree in Law (LLB) from University of the West of England, Bristol and Certificate in Legal Practice.
Joshua has been in practice for 14 years, having previously practiced at Messrs Wong Choo & Partners. He is currently the Founder and Managing Partner of Messrs Joshua & Associates, where his core practice encompasses Estate Administration, Family Law, and General Civil Litigation.
Joshua has attended to more than 1000 estate administration cases to date.
Venny Shu Nyet Moi is a Partner at Messrs Shu Yin Teh & Taing, currently heading the firm’s Kajang, Selangor branch. Admitted to the Malaysian Bar in 2011, she has built a distinguished 15-year career in legal practice. Her practice focuses on Conveyancing, Estate Administration matters, Banking and Finance matters, and Corporate agreements.
Venny has significant experience in probate and estate administration matters, regularly assisting clients with applications for Grant of Probate and Letters of Administration; attending to various transfers of properties post Death; drafting wills and advising on estate distribution; and handling caveats, renunciations, and citations.
