We refer to the earlier circulars from the Committee, amongst others no. 23/2022, 28/2022, 30/2022, 31/2022 and 34/2022 pertaining to the implementation of the “Tatacara Penggunaan Akuan Penyerahan Dokumen Pentadbiran Tanah Johor” by Pejabat Tanah dan Galian Johor (PTG) and the Committee’s concerns on the implications of the Tatacara, which had been duly communicated to the PTG. The PTG has however proceeded with the implementation of the said Tatacara.
Following this, kindly be informed that a judicial review application in the name of the Malaysian Bar as the applicant has been commenced against the Registrar of Titles, Johor, Land Administrators (In the State of Johor) and Pengarah Tanah dan Galian, Johor as the respondents on 15.9.2022 at the High Court in Johor Bahru. The application for leave to apply for judicial review is fixed for case management on 25.10.2022. In the event that leave is granted, the reliefs sought in the judicial review application includes a declaration that the said Tatacara (containing therein a “Surat Akuan” and a “Akuan Pemohon”) is null and void and/or ultra vires the National Land Code 1965 and for consequential orders thereupon and further for interim reliefs pending the disposal of the judicial review application.
