We are pleased to announce that the Professional Development & Education Sub-Committee is organizing a seminar on “Professional Liability: Solicitors’ Duties And Liabilities in Litigation.”
Litigation or dispute resolution is a primary area of practice for solicitors in the country. Litigators, as they are commonly referred to, are bound by and subjected to various duties, responsibilities, and obligations both professionally and personally by the client, the Courts, the Bar, and at times, even by third parties, when handling a litigation. The failure to comply and adhere with such duties and responsibilities often result in serious consequences, professionally and financially.
Keeping these duties and liabilities in mind, the talk will address the following issues concerning litigators: sources of duties and obligations that regulate the conduct of litigators, duties and responsibilities of litigators; role and duty as officers of the court; the standards of conduct expected of litigators; potential liabilities and defences.

About the Speaker
R. JAYABALAN graduated with Bachelor of Law (LLB Hons) from the International Islamic University Malaysia in 1996 and obtained his post-graduate Master in Business Administration (MBA) from International Islamic University Malaysia in 2004.
Jaya was called to the Bar in April 1997. He has been in active practice since then based in Johor Bahru and conducting litigation in various courts. He is the principal of his own firm Messrs R. Jayabalan.
His main area of practice is litigation and dispute resolution. He is an active litigator at trial and appellate level. He regularly appears at all levels of courts from Magistrates Court, Sessions Court, High Court, Court of Appeal and Federal Court. He also conducts litigation at the Industrial Court and arbitration.
Jaya’s main area of practice is professional negligence, industrial relations and employment law, general tort, contract/commercial law, insurance and banking law, land and strata laws and administrative law amongst others. He also actively writes and speaks on various issues of law and procedure and on issues concerning legal practice in the country.
Jaya is a member of the Bar Council. He has served as Chairman of the Johore Bar and is currently the Bar Rep and Treasurer of the Malaysian Bar. He chairs the Finance Committee and is the Deputy Chair of the Risk Management Committee of the Bar Council.
