Circular No. 40/2022: Corporate Liability For Environmental Harm Caused by Foreign Subsidiaries & Its Application In Malaysia (11 Aug 2022)

Please be informed that the Continuing Professional Development and the Publications & Information Technology Sub-Committees of the Johore Bar Committee are organising the above titled Webinar.

This Webinar will assist the participants to understand the historical developments of parent company liability for tort committed by its foreign subsidiaries, and focus on three recent English cases where the courts have held that a parent company may be liable under tort for environmental harm caused by its overseas subsidiaries: Lungowe v Vedanta Resources plc [2019] UKSC 20; Okpabi & Others v Royal Dutch Shell Plc & Another [2021] UKSC 3, and Municipio De Mariana v. BHP Group [2002] EWCA Civ 951. The Webinar will also offer insights on how these case laws may apply here in Malaysia and explore potential remedies for environmental harm in Malaysia.

About the Speaker

KWONG CHIEW EE is a Partner at Rahmat Lim & Partners. Chiew Ee’s areas of practice include corporate and commercial litigation, restructuring and insolvency, and international arbitration. She is also part of the Firm’s ESG & Public Policy practice.

She has represented a wide range of clients, including multi-national corporations, liquidators, receivers and managers, financial institutions, and foreign clients, in a multitude of disputes at all levels of court in Malaysia and in both institutional and ad hoc international and domestic arbitrations. Chiew Ee is listed in the Asian Legal Business’ Rising Stars Malaysia list 2022, which showcases Malaysian lawyers under the age of 40 currently doing high quality work and earning accolades from their clients.

Chiew Ee is a Fellow of the Chartered Institute of Arbitrators and an Accredited Tribunal Secretary at the Hong Kong International Arbitration Centre. She also sits in the Panel of Arbitrators at the Thailand Arbitration Center. She was admitted as an Advocate & Solicitor of the High Court of Malaya in 2012.

Chiew Ee is a member of the Bar Council Environment & Climate Change Committee. She is also the sole Malaysian National Rapporteur for Climate Change Litigation at the Sabin Center for Climate Change Law, Columbia University, New York. She holds an adjunct faculty position in a Malaysian university where she teaches international dispute resolution. Chiew Ee is Professional Fellow under the Young Southeast Asian Leadership Initiative Professional Fellowship Program (Sustainable Development and the Environment Institute Theme), a fully-funded leadership and professional development exchange program sponsored by the U.S. Department of State’s Bureau of Educational and Cultural Affairs.

She graduated from the University of London with a Bachelor of Laws (Hons) degree in 2010. She also holds a Master of Law from the London School of Economics and Political Science.
