We refer to Circular No. 12/2023 and Circular No. 49/2023 regarding the judicial review proceedings initiated by the Malaysian Bar concerning the implementation of the “Tatacara Baru” by the PTG. Following the dismissal of the substantive judicial review application on 1.8.2023, an appeal was filed to the Court of Appeal, which was fixed for decision on 24.4.2025.
Members are hereby informed that the Court of Appeal has allowed the Malaysian Bar’s appeal and ordered as follows:
1. The Respondents (Registrar of Titles, Johor, Land Administrators (in the State of Johor), Pengarah Tanah dan Galian Johor) are to immediately cease the implementation and enforcement of the “Surat Akuan” and “Akuan Pemohon” under the said Tatacara;
2. Any such documents signed, obtained, or received prior to the date of the Order are declared null and void, and of no legal effect;
3. No order as to costs.
The Johore Bar Committee records its appreciation to Dato’ Yeo Yang Poh and all those who have assisted and supported the process throughout the conduct of the matter.
