Please be informed that a meeting was held between the Johore Bar Committee (JBC) and Bahagian Pendaftaran Hakmilik Pejabat Tanah dan Galian Johor on 30th May 2022. Several pertinent issues were deliberated and resolved between the parties, as follows:
(a) Issue: Whether the release letter for bumiputra lots for the previous transaction should be submitted when a new transfer is to be effected at PTG?
PTG response: Not required
(b) Issue: For matters concerning land leased to TNB for construction of its sub-station, is there any requirement to attach the letter of approval of TNB when any dealings such as a charge is to be registered?
PTG response: Not required
(c) Issue: For CTC (Certified True Copy) of supporting documents presented to PTG for registration such as bumiputra’s release letter, who are the persons acceptable to PTG to CTC the documents other than a solicitor?
PTG response: PTG only allow CTC by (i) the issuer of the documents OR (ii) a Solicitor
(d) Issue: whether there is a need for a developer to file in Form 378 to endorse the new company number issued by SSM for registration of Form 14A?
PTG response: Not required
(e) Issue: If Form 14A is signed by the attorney of the developer via the Power of Attorney conferred to him, is there any requirement for Form 49 or other company’s documents to be submitted together with the Form?
PTG response: Form 49 is required to be submitted
(f) Issue: What are the relevant documents required to be submitted for the transfer of property to a Limited Liability Partnership?
PTG response: PTG will liaise with SSM on the matter to streamline the relevant documents to be submitted and will revert to JBC.
(g) Issue: What is the time frame fixed to obtain approval for cases involving application for acquisition of assets which are more than RM10 Million?
PTG response: PTG will forward the application to Pejabat Menteri Besar within 14 days from the date of receipt of such application.
(h) Issue: What is the document that need to be submitted for dealings of property where a Registrar caveat is entered into such a land where a gross development value (GDV) has been imposed for service apartments or block titles?
PTG response: Form 19F is required
