Circular No. 97/20: Movement Control Order 2.0 | Updates on Conduct of Civil Proceedings In All Courts [High Courts And Lower Courts]

MCO 2.0 has been extended in the State of Johor until 04/03/2021.

By ARAHAN KETUA HAKIM NEGARA BILANGAN 5 TAHUN 2021 MENGENAI PENGENDALIAN PROSIDING KES SIVIL DI MAHKAMAH SEMASA TEMPOH PERINTAH KAWALAN PERGERAKAN (PKP) [APPENDIX-1], directives on the conduct of civil proceedings in all courts in Peninsula Malaysia were issued.

Following that, all civil matters will proceed per usual in open court; there will no longer be a duty schedule for Judges, Sessions Court Judges and Magistrates. Cases will be fixed on staggered timings.

The conduct of hearings by physical attendance is primarily for cases registered pre-2020 as well as public interest cases and those involving special or extraordinary circumstances, for example cases filed on certificates of urgency, 2020 or 2021 cases requiring urgent examination of witnesses due to health reason. Matters which do not involve the physical attendance of a member of the public may be conducted online (ie email, Skype, Zoom).

Cases already scheduled to be conducted online (ie e-Review, email, Skype, Zoom etc) will proceed as scheduled.

The duty schedule of the Deputy and Senior Assistant Registrars, High Court Johor Bahru from 19/02/2021 to 30/06/2021 is attached here as APPENDIX-2.

Video Conference Facilities are available at the Secretariat from Monday to Friday at 8:30 a.m. to 5:30 p.m. As the use of these facilities is subject to availability, members are required to make prior reservation, with the Secretariat, for the specific time and date.
