Circular No. 32/13: Dealing with Court Matters

Overview

Issues concerning the courts and the administration of justice arise throughout the year and take up a fair bit of the Committee’s time. As in the past we would continue to act speedily and effectively on all issues that are brought to our attention. Most issues are purely administrative in nature and are relatively easy to resolve, but from time to time, we receive complaints both from our members and the public, that are more complex and challenging, and these may take longer to resolve. In particular, complaints against judicial officer are very sensitive in nature and should be handled tactfully and discreetly. It is also important that such complaints must be specific and supported by actual instances of alleged improper conduct, and should not be vague or general.

Courts Liaison and Public Relations Sub-Committee

The Courts Liaison and Public Relations Sub-Committee has been tasked with the function of handling all issues and complaints pertaining to the courts. The Sub-Committee is comprised as follows:

(11) Ms. Punitha Mariappan

(12) Puan Suzana Sudin

(13) K. Vijay Kumar

(14) Bustaman Menon

(15) Lim Chon Sin

The sub-committee will meet at least six times during the year to discuss and to deal with the problems and complaints that are referred to us.

Directing your complaints

Members facing any difficulty in court or who are unhappy with anything concerning the administration of justice may direct their complaint to the Committee by:

(a) writing directly to the Johore Bar Committee; or

(b) filling up and submitting to the Johore Bar Secretariat, the complaint forms that are available at the Johore Bar Secretariat and the Johore Bar Room located at:

(i) the Civil Court at Level 25 Menara MSC Cyberport, Johor Bahru,

(ii) the Criminal Court at the old Subordinate Court Building at Jalan Ayer Molek, Johor Bahru, and

(iii) the Muar Court Complex; or

(c) giving their input at the Forum on Court Matters that would be held at regular intervals.

Urgent Matters

Members facing any difficulty in court that requires immediate action, may instead of writing, approach or contact the following members of the Courts Liaison and Public Relations Sub-Committee, who have been appointed as the Court Liaison Officers, for urgent action to be taken:

(a) Ms. J. Chandrika for Family Law matters;

(b) Ms. Punitha, Puan Suzana and Ms. Meneka for Running Down matters;

(c) Ms. Santhi and Puan Nas Idalina for Bankruptcy, Banking and Foreclosure matters;

(d) Mr. Vijay Kumar and Mr. Sasindran for E-filing and CRT system; and

(e) Mr. Lim Chon Sin and Mr. Bustaman Menon for Criminal Cases.

The said persons have been authorised to take up the matter immediately with the appropriate Judicial Officer or Registrar, as the case may be, for resolution, and if the matter is not resolved immediately or within seven (7) days, depending on the nature of the problem, the matter would be referred to the Senior Judge of the High Court for his intervention.

Johore Bar Forum on Court Matters

We propose to hold at least five forums during the year for members to air their grievances. The tentative dates for the said Forum are as follows:

1st Forum – 24th April 2013 (DONE)

2nd Forum – 19th June 2013 (DONE)

3rd Forum – 28th August 2013

4th Forum – 16th October 2013

5th Forum – 15th January 2014

Further forums may be called if there is a need or call from members.

Meetings with the Senior Judge of the High Court in Johor Bahru

The Committee plans to meet the Senior Judge of the High Court in Johor Bahru on a regular basis to discuss and resolve the issues referred to us. Five such meetings have been planned for the year, the tentative dates for which are:

1st Meeting – May 13-17, 2013 (DONE)

2nd Meeting – June 24-28, 2013 (DONE)

3rd Meeting – September 9-12, 2013

4th Meeting – October 28-31, 2013

5th Meeting – January 20-24, 2014

Criminal Law Practice

In order to cater to the needs of the Criminal Bar, we plan to hold at least two dialogue sessions with the Judge of the High Court in Johor Bahru in charge of the criminal courts. The tentative dates for the said dialogue sessions are as follows:

1st Session – August 2013; and

2nd Session – December 2013
