The Continuing Professional Development Sub-Committee of the Johore Bar is organizing a SEMINAR ON AN INTRODUCTION TO THE LAW OF PASSING OFF that will be conducted by MR. ARUNACHALAM KASI, a member of the Kuala Lumpur Bar.

The workshop is aimed at delivering to the participants a basic understanding of the law of passing-off. In principle, it is a ‘passing-off’ when a trader sells his goods as that of another trader. This branch of law is provided by the common law and co-exists with the Trade Marks Act 1976 that regulates registered trademarks.

The speaker will present this topic in a structured way with reference to the relevant case law. He will briefly introduce what is passing-off, its origin, its objectives, its relationship to law of trademarks, its co-existence with the Trade Marks Act 1976, its expansion beyond the classical form. Thereafter the speaker will introduce the three legal requisites of classical passing-off claim, namely the relevant goodwill of the claimant. Then he will elaborate on each of the three requisites with reference to and discussion of case law.

The Bio-data of the Speaker

Mr. Arunachalam Kasi, a practicing lawyer, graduated in 1994 with his law degree at the age of 19. This followed his completion of A-Level at the age of 15 and his works in economics at the age of 16. Notably he was referred for Nobel Prize for his works in Economics. He specialized in the Law of Trade Marks as part of his LLM degree programme at the University of Malaya. He is an inter-disciplinary person who also skills in computer science. He has recently combined his expertise in law and computer science by releasing an application software that will assist legal practitioners in their work.
