In the last few weeks, the PTG has imposed double search fees where searches are conducted using old title numbers when new titles have been issued. This has caused various problems to our members, particularly those who practice conveyancing, not least because it translates into additional costs and disbursements to the public.
The Johore Bar Conveyancing Sub-Committee has on 26-7-2012 met up with Encik Mohammed Ridha Bin Dato’ Abd Kadir, Timbalan Pendaftar (Pendaftaran), to discuss, inter alia the unfair and unreasonable practice of double charging which was imposed without prior notice or consultation.
We informed Encik Mohammed Ridha that since PTG does not notify landowners when new titles are issued, it is unfair and unreasonable to penalize when land title searches are conducted using old title numbers.
While agreeing, Encik Mohammed Ridha qualified that there may be situations where requests for land title searches are made specifically on the old titles eventhough new titles are issued.
Be that as it may and in the circumstances, Encik Mohammed Ridha has instructed his front desk staff to enquire whether land title searches are to be done on the new titles or old titles. If the new titles are issued, then there is no additional fees payable eventhough the request is made using the old title numbers.
Encik Mohammed Ridha has also requested the Johore Bar Committee to inform our members that WHEN CONDUCTING LAND TITLE SEARCHES, MEMBERS DO NOTIFY THE PTG’S FRONT DESK STAFF THAT THE SEARCHES ARE TO BE DONE ON THE NEW TITLES ALTHOUGH OLD TITLE NUMBERS ARE FURNISHED FOR THE PURPOSE OF SEARCHES.
