The Yayasan Bantuan Guaman Kebangsaan (“YBGK”) was launched by the Prime Minister on 25/2/2011 to provide legal aid for those requiring representation in criminal proceedings. Presently the service is provided to represent persons arrested immediately upon arrest, during the remand stage and for bail applications when they are charged in court. Eventually it would be extended to defending them in court.
The Bar Council’s Legal Aid Centres are working closely with and assisting YBGK in the delivery of these services. Members of the Bar who volunteer their services would be remunerated by YBGK, in accordance with the rates determined by YBGK. A copy of the said rates in enclosed herewith for your perusal.
In Johor YBGK legal aid is now being implemented within the Johor Bahru and Pontian Police Districts.
With your support and co-operation, the Johore Bar Committee hopes to extend the service to the Northern Johore region, namely Segamat, Muar, Batu Pahat, Kluang and Yong Peng.
In order to provide legal services for YBGK, an advocate and solicitor has to be accredited by YBGK and for this purpose it is mandatory for him/her to undergo a 1-day training session, that would be conducted by the Malaysian Bar Council.
To hold a training session, at least 30 participants are required. Given the jurisdictions referred to above, at least 6 are requested from each district.
We urge you, including those who have not handled criminal cases before, to sign up for the training session and to make this programme a success.
Upon meeting the numbers, we will request for the training session and inform you accordingly.
