Circular No. 63/2022: Understanding Valuation Reports & Dealing with Matrimonial Assets (17 Nov 2022)

Please be informed that the Continuing Professional Development and the Publications & Information Technology Sub-Committees of the Johore Bar Committee together with the International Academy of Collaborative Practice (IACP) are organising the above titled Webinar.

This Webinar will deal with the following issues:-

  • Dealing with Matrimonial Assets
  • When dealing with family cases, a big component is the issue of the parties’ matrimonial assets and how they are to be dealt with. This involves various aspects, firstly to ascertain and identify what the matrimonial assets are, secondly to consider the legal provisions and case law to determine the division and thirdly, to consider how to achieve the best outcome. To advise clients properly, a strong knowledge of the law is required, together with practical skills on how to obtain disclosure, discovery and tracing of assets. This talk will focus on the practical aspects of these matters to tailor the best approach when advising clients.

About the Speakers

Ms Ann Chuah Siew Ean from Messrs Hisham Yoong – K.C. Lim was called to the Malaysian Bar in 2009 and her main area of practice is compulsory land acquisition. She has represented both Lembaga Lebuhraya Malaysia for the West Coast Expressway (WCE) and the landowners in various projects such as Mass Rapid Transit (MRT), Light Rapid Transit (LRT) and East Coast Rail Link (ECRL). She has extensive experience in land acquisition and land related matters having worked in the Valuation and Property Services Department, Ministry of Finance for 33 years. She is a trained collaborative practitioner under the International Academy of Collaborative Professionals (“IACP”) and also a member of the Bar Council Family Law Committee. She is also a trained mediator and advocates shielding children from the impact of an acrimonious divorce as the best interest of the children should be a primary consideration.

Ms Kiran Dhaliwal is a Partner at Messrs Y. N. Foo & Partners in Kuala Lumpur. Called to the Malaysian Bar in 1993, since1997 her practice has concentrated on family law. She deals with complicated divorce and custody cases, including with cross-jurisdictional elements. Kiran’s wide range of experience allows her to assist clients to achieve the best outcome for themselves, whether by litigation or by using her skills as a mediator and a Collaborative lawyer. Kiran is a member of the Bar Council Family Law Committee, a fellow of the International Association of Family Lawyers (IAFL), a mediator and an inaugural member of the Malaysian group of Collaborative Lawyers registered with the International Academy of Collaborative Professionals (IACP). Kiran has contributed to various publications on Malaysian Family Law in collaborations published locally in Malaysia and internationally.

About the Moderator

Ms Rajashree Suppiah has an LLB from the University of London and has been in practice since 1997. Her practice straddle all three areas of litigation, collaborative practice and mediation. As an experienced litigator she has been involved in many areas of practice including contentious matrimonial matters and cross borders custody disputes. She was one of the pioneers in Malaysia who underwent collaborative training with International Academy of Collaborative Professionals (IACP), an international community of legal, mental health and financial professionals working in concert to create client-centred processes for resolving conflict. She serves on the Malaysian Bar Family Law Committee (FLC) and is the current head of the Collaborative Practice Subunit of the FLC. Rajashree also serves as the Co-Group Leader of the Malaysian Collaborative Practice Group (MCPG). She also serves on the Diversity Equality and Inclusion Committee of IACP.

CPD points will be given upon completion of the whole session to participants who have attended until the end of the event based on the online report of ‘logged-in’ duration.
