Circular No. 43/19: Solicitor’s Negligence – Avoiding Common Errors (15 Aug 2019) And Dealing with Disciplinary Board Complaints – How to Defend Yourself (16 Aug 2019)

SEMINARS ON

  1. SOLICITOR’S NEGLIGENCE – AVOIDING COMMON ERRORS
  2. DEALING WITH DISCIPLINARY BOARD COMPLAINTS – HOW TO DEFEND YOURSELF

Please be informed that the Continuing Professional Development Sub-Committee is organizing a 2 Part Seminar on Solicitor’s Negligence and Dealing with Disciplinary Board Complaints.

As with any profession, lawyers have to exercise reasonable skill and care in carrying out their duties. The failure to do so could result in a Solicitor’s Negligence suit against lawyers in court and/or a complaint against lawyers lodged with the Advocates & Solicitors Disciplinary Board. In an increasingly litigious community, we have seen the claims for professional negligence growing rampantly and a similar increase in the complaints lodged with the Disciplinary Board.

Therefore, now, more than ever, it is important for all lawyers to arm themselves with the knowledge on how to avoid common errors in the discharge of their duties and the understanding of the steps and procedure to be taken should they find themselves being sued and/or complained against. These seminars aim to provide the practical and technical guidance to lawyers on risk-management and the know-how in dealing with Professional Negligence suits and/or Disciplinary Board complaints.

The 1st Seminar will be delivered by Mr. S. Gunasegaran and Mr. George Neo, both of whom act for the Malaysian Bar Professional Indemnity Scheme and have had practical experience in defending professional negligence suits against lawyers.

The 2nd Seminar will be delivered by Mr. Krishna Dallumah who has served on the Advocates & Solicitors Disciplinary Board and has a wealth of knowledge on the criteria in ascertaining misconduct.
