Please be informed that the Continuing Professional Development Sub-Committee of the Johore Bar is organising a Seminar on “Indefeasibility Of Title Under The National Land Code In Malaysia”

The seminar will deal with:

  1. Indefeasibility of title – S.340 (1) NLC

(a) What constitutes registration? – S.304 NLC
(b) What is Indefeasibility of title? – S.340 NLC
(c) Meaning of “Shall not be Indefeasible”? – S.340 (2) NLC

i. Fraud:

Definition of Fraud; and
Whether mere knowledge of unregistered claim/interest amount to fraud?
ii. Misrepresentation S. 340 (2) (a)
iii. Forgery S. 340 (2) (b)
iv. Void or insufficient instruments S. 340 (2) (b)
v. Unlawful acquisition of power of authority S. 340 (2) (c):
Registration of dealing in contravention of a restriction in interest;
Registration of a dealing notwithstanding the prohibition imposed by a caveat; and
Registration of a certificate of sale where the power of sale has been improperly exercised.

2. Purchasers in good faith (Bona fide purchasers for value) – S. 340 (3) NLC
(a) When are you considered a “Purchasers in good faith”?
(b) The Malaysian interpretation of a “Purchasers in good faith”
(c) The Common Law approach to the interpretation of a “Purchasers in good faith”

About the Speaker

Sudharsanan Thillainathan joined Shook Lin & Bok in 1997as an associate. He became a partner in 2004. His main practice areas include Corporate & Insurance Litigation, International & Domestic Arbitration, Competition Law and Tax Litigation. He is currently the Deputy Head of the Tax Department. Mr. Sudhar has been involved in the conduct of a number of leading local cases in the areas of arbitration, insurance, local/public authorities and tax law. He has also been involved in the conduct of a number of domestic and international arbitrations. Mr. Sudhar recently participated in the inaugural Singapore International Arbitration Academy 2012, presented by the Centre for International Law, National University of Singapore where he was a recipient of the Award for Excellence in Advocacy.

If a participant is unable to attend, a replacement is allowed provided that the Secretariat of the Johore Bar is notified in writing prior to the commencement of the event. CPD points and Certificate of attendance will be given upon completion of the whole session to participants who have attended until the end of the event. However, certificate of attendance shall not be awarded to late comers or those participants who attend this event after 15 minutes upon its commencement.
